Right to Cancel

You may cancel this contract from the day you enter into the contract until three (3) business days after you receive a copy of the contract. You do not need a reason to cancel.

If you cancel this contract within the allowed period, GS Exterior Experts has fifteen (15) days to refund any payments received. To cancel, you must give written notice of cancellation to the address listed in this contract. Notice must be provided in a method that allows you to prove delivery, including registered mail or personal delivery.

Renderings and Visual Representations

Any rendering, mockup, or visual representation is provided to give a general idea of color and style and is not to be construed as the exact final appearance of the completed project. Small details, dimensions, trim sizes, layout, and placement of materials will be based on field conditions and your actual home, not solely on renderings.

Materials and Ownership

GS Exterior Experts orders extra materials to ensure proper installation and timely completion of the project. Any excess or unused materials remain the property of GS Exterior Experts unless otherwise agreed upon in writing.

Interior Wall and Vibration Notice

I understand that I must remove items from interior walls and areas that may be affected by vibrations from installation work. GS Exterior Experts is not liable for damages caused by normal construction vibrations. Drywall cracking, nail pops, or minor movement may occur and are considered natural results of construction activity.

Pre-Existing Conditions

GS Exterior Experts is not responsible or liable for any pre-existing construction defects. This includes but is not limited to framing deficiencies, structural issues, existing roof or flashing problems, cracks in walls, foundations, or masonry that are already deteriorating.

Delays Beyond Control

GS Exterior Experts shall not be liable for failure of performance under this contract due to weather, labor disputes, fire, inability to obtain materials from usual sources, permit delays, or any other circumstances beyond GS Exterior Experts control.

HOA and Municipal Compliance

PURCHASER/Homeowner is responsible for compliance with any homeowner association, city, county, subdivision, or municipal requirements or restrictions that may regulate or affect the work to be performed under this contract. This includes any restrictions on materials, colors, or design selections.

Arbitration and Dispute Resolution

All claims and disputes arising out of or related to the project, the work, or this agreement shall be settled by arbitration in accordance with the Construction Industry Arbitration Rules of the American Arbitration Association currently in effect.

Notice of demand for arbitration shall be filed in writing with the other party and the American Arbitration Association. All demands shall be made within a reasonable time after the claim or dispute has arisen.

Job Site Safety and Pets

I understand that this is an active job site and that proper footwear and caution must be used when walking around the work area. I am solely responsible for my pets or animals and their well-being while they are on the job site. GS Exterior Experts cannot be held liable for pets or animals.

PURCHASER/Homeowner will not walk under or near the work area during demolition, tear-off, or installation. GS Exterior Experts shall not be liable for any injuries to persons or pets. PURCHASER/Homeowner agrees to indemnify and hold harmless GS Exterior Experts from any and all claims arising from GS Exterior Experts performance of this agreement.

Warranties

I understand that any warranty for materials used during the project is provided by the material manufacturer. Unless agreed upon otherwise in writing, GS Exterior Experts provides a limited workmanship warranty on portions of the project in which GS Exterior Experts fully replaced existing products.

Driveway and Property Considerations

Driveway or surface damage may occur from dumpsters or material deliveries. Any issues or damages related to dumpsters or delivery equipment are between the homeowner and the dumpster or delivery company. GS Exterior Experts cannot be held liable.

Electrical and Hidden Conditions

If any unforeseen electrical or mechanical issues arise, the homeowner will contract with a licensed professional and will be solely responsible for all costs associated. This includes situations where hidden wiring or utilities are encountered during installation.

Payment Terms

I understand that payment in full is due upon completion of work as stated in the contract unless otherwise agreed in writing. All invoices not paid in full after fifteen (15) days may be subject to a 2% per month interest charge or the maximum allowed by law.
